Overview

This website, petmercantile.com (the "Site"), is operated by Photon LLC, doing business as Pet Mercantile ("we", "us", "our"). These Terms of Service ("Terms") apply to your use of the Site and to any purchase you make from us. By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.

Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account, you are responsible for keeping your login details secure and for activity under your account.

Products and descriptions

We try to describe and photograph products accurately. Colors can look different on different screens, and sizes may vary slightly from the measurements shown. Products are for pets and are not toys for children. Supervise your pet with any new toy, chew, harness or bed, and stop using an item if it becomes damaged. Nothing on the Site is veterinary advice; ask your vet about your pet's health.

Prices and payment

Prices are in US dollars. Shipping costs and any applicable sales tax are shown at checkout before you pay. We may change prices at any time, but a change does not affect an order we have already confirmed. Payments are processed by Shopify and its payment partners; we do not store your full card details.

Orders

An order is a request to buy. We may refuse or cancel an order, for example if an item is out of stock, the price was shown in error, or we suspect fraud. If we cancel after you have paid, we refund you in full. We may limit quantities per order.

Shipping, returns and refunds

Delivery is described in our shipping policy, and returns and refunds in our returns policy. Both form part of these Terms. Title and risk of loss pass to you when the item is delivered.

Reviews and content you send us

If you post a review or send us photos, comments or other content, you confirm it is your own, truthful and lawful, and you give us a non-exclusive, royalty-free license to use, reproduce and display it in connection with the Site and our marketing. We may remove content at our discretion. We do not pay for or edit reviews to change their meaning.

Intellectual property

The Site's text, design, logos, graphics and photos belong to us or our licensors. You may not copy or reuse them without our written permission.

Prohibited use

You may not use the Site for any unlawful purpose, to interfere with its security or operation, to scrape it in bulk, or to send spam or malicious code.

Third-party services

The Site uses services from third parties, such as Shopify, payment providers and review tools, and may link to other websites. Their own terms and privacy policies apply, and we are not responsible for them.

Disclaimer

Except as stated in these Terms or required by law, the Site and products are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or any product. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states do not allow these limits, so they may not apply to you.

Indemnity

You agree to indemnify and hold us harmless from claims arising from your breach of these Terms or your misuse of the Site.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. If any part of these Terms is found unenforceable, the rest remains in effect.

Changes

We may update these Terms from time to time. The date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
